3. User Eligibility and Responsibilities
You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these terms. You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service.

6. User-Generated Content
If you submit, post, or display content on the Apartment Clarity Service (including photos, reviews, or feedback), you grant Apartment Clarity a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of improving and promoting the Service. You represent and warrant that you own or have the necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws.
7. Service Disclaimers
The Service is provided on an "as-is" and "as-available" basis. Apartment Clarity makes no warranties, express or implied, regarding the Service, including but not limited to:

Apartment Clarity does not warrant that the diagnostic tools will identify all apartment issues or that recommended solutions will resolve all challenges. The Service is designed to provide guidance and support, not professional legal, structural, or engineering advice. For matters requiring specialized expertise (such as structural repairs, legal lease disputes, or health and safety concerns), you should consult with appropriate qualified professionals.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Apartment Clarity shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Loss of data, revenue, or profits
- Damage to property or personal injury
- Disputes with landlords, property managers, or other tenants
- Financial losses related to deposits, rent, or lease agreements
- Failure to complete a move or cleaning project as expected
In no event shall Apartment Clarity's total liability to you for all claims arising from or related to the Service exceed the amount you paid to Apartment Clarity in the 12 months preceding the claim, or €100, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so this limitation may not apply to you in full.
9. Indemnification
You agree to indemnify, defend, and hold harmless Apartment Clarity, its owners, employees, agents, and service providers from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service or violation of these terms
- Your violation of any applicable law or third-party rights
- Content you submit or actions you take through the Service
- Disputes between you and third parties (including landlords or other service providers)

11. Payment and Cancellation
If you book paid services through Apartment Clarity, you agree to provide accurate payment information and authorize Apartment Clarity to charge the agreed-upon fees to your payment method. Payment terms, cancellation policies, and refund eligibility are detailed in the booking confirmation and service agreement provided at the time of purchase.
Apartment Clarity reserves the right to refuse or cancel any booking that violates these terms or appears fraudulent. Refund requests must be submitted in accordance with the cancellation policy applicable to your specific service.
12. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. You agree that any legal action or proceeding arising from or related to these terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.
Before initiating formal legal proceedings, you agree to attempt to resolve any dispute through good-faith negotiation with Apartment Clarity. If negotiation does not resolve the matter within 30 days, either party may pursue legal remedies available under German law.
13. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these terms. The remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms of Service, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Apartment Clarity regarding the Service and supersede all prior negotiations, understandings, and agreements, whether written or oral.
